Shaping rights protection in the domain name system

By the end of this year there will be c. 350 million domains across 24 legacy gTLD registries, 300 ccTLD registries and 1,200 new gTLD registries. Of these new gTLDs c. 600 registries are completely unrestricted. This dramatic growth of the DNS requires new brand protection strategies; defensive registration across the board is hardly practical or affordable.

ICANN introduced new Rights Protection Mechanisms (RPMs) intended to help - but have they done so? Two formal Working Groups within ICANN are meeting every week to review those RPMs and to make recommendations on “Subsequent Procedures” – meaning how Round Two of the new gTLD program is managed. Whilst this presents opportunity for improvement, there are also challenges. Efforts are hampered by a lack of data and examples of "harm", and not all participants have a respect for IP.

The aim of this interactive day is to obtain the views of UK IP community on the future shape of RPMs in the domain name system. We will collate and present our findings to the ICANN working groups, as well as to UK government representatives who will attend the day so that they can be fed into the  process in order to make Subsequent Procedures (Round Two) a better experience.

  • The IPO – the UK’s Intellectual Property Office
  • ICANN’s Board directorate
  • World Intellectual Property Organisation (WIPO)
  • New gTLD and ccTLD registries including Nominet
  • The Brand Registry Group
  • Two of the co-chairs of the ICANN Working Groups on Rights Protections and Subsequent Procedures
